By acquiring Manifold products through the Manifold Online Store or by any other means you agree to the terms and conditions and procedures set forth on this page. Do not acquire Manifold products if you do not agree to these terms and conditions and procedures.

Returns: Pursuant to the following terms and conditions, when ordered as an individual product in a single-unit order, Manifold System Release 7x Personal, Manifold 7x Personal + Geocoding, Manifold System Release 7x Professional, Manifold 7x Professional + Geocoding, Manifold 7x Enterprise and Manifold 7x Enterprise + Geocoding editions are shipped with a one-time, 30 day satisfaction guarantee for a single license per person or per household or per organization that is available to the original purchaser for either 30 days after the product is shipped or until you request an Activation key or order an upgrade, whichever comes sooner. Other Manifold products such as Manifold System 7x Universal Edition, Ultimate Edition, Database Administrator Edition, Option Pack and any other products not explicitly listed as refundable are not refundable. Geocoding Tools as a standalone purchase or other products not explicitly listed above are not refundable. Orders for multiple units are not refundable, not even for one of those units. Runtime licenses are not refundable.
Very important: the limited money-back guarantee runs 30 days from the date your product is shipped, not from the date on which it is delivered. It is the customer's responsibility to choose a shipping method that allows adequate time for shipment of Manifold and subsequent use. For example, if you are not sure that you wish to keep your license, do not use Global Priority mail for delivery to international locations, since Global Priority mail delivery times are not guaranteed. Use Federal Express so you can be sure of receiving your package within a reasonably predictable time.
Very important: the limited money-back guarantee is intended to allow a single examination of Manifold System without financial risk. It is not intended as a "rental" or "loan" program or as a means of returning surplus licenses. For example, if you have or your organization has at any time licensed Manifold System and passed the 30 day refund time for any Manifold license, fetched an Activation key for any license or upgraded any Manifold license you do not thereafter have the ability to refund any future Manifold license. The first license you obtained gave you the opportunity to review Manifold and to understand what it is. Subsequent licenses, especially those after previous activations or upgrades, had the benefit of a prior review of Manifold and are not refundable.
The money-back guarantee is available to credit card purchasers and organizations purchasing with a PO. The money-back guarantee is not available to wire transfer or check prepaid transactions. The money-back guarantee is not available for any discounted price orders, not even for the three listed SKUs if purchased at a discount. The money-back guarantee is not available in reseller transactions. You may return Manifold System for full credit of the license fee (for example, $245 for Personal Edition) up to 30 days after the product is shipped. Shipping, handling or other charges are not refundable. You must pay shipping and handling expenses both ways. Before returning the product, within 30 days of your purchase you must contact Manifold Net at sales@manifold.net to get a Returned Material Authorization (RMA) number and the correct address for returns. Products returned within the 30 day period without an RMA number will be subject to a $50 processing fee, which will be deducted from any refunded amount.
Allow two weeks for processing of refunds. No refunds will be made on credit card orders with charges not yet paid. Products other than those listed explicitly above are not returnable. Manifold System 7x Universal Edition is not refundable. Also, accessories or other products such as Geocoding Tools (when acquired as a standalone product and not as part of a Manifold System + Geocoding bundle), Digital Chart of the World or Manifold World are not refundable. Any runtime versions or other products other than the SKU numbers listed are not refundable. Technical support or other service products are not refundable. Do not purchase any accessories for Manifold System, such as data sets or technical support products, unless you are sure you will not be returning Manifold, since such accessories are not returnable and they often are not usable without Manifold System. Only the first license of Manifold System (per individual, per household and per organization) is refundable, regardless of which release or edition has been licensed.
Upgrades for Manifold System (such as upgrades from Professional to Enterprise or an Upgrade to 7x DVD or any upgrade product from earlier editions) are not returnable. Ordering an upgrade for any edition of Manifold System waives refund privileges for the qualifying product. For example, if you order Professional edition and then two weeks later order an upgrade to Enterprise edition for your Professional license you will terminate the return privilege for your Professional license as well as for the Enterprise upgrade. Submitting an Academic License application waives return privileges for the qualifying product. The return privilege is a one time opportunity regardless of which version or edition of Manifold System you return. For example, if you have previously purchased and returned for refund a 5.00 version of Manifold System you do not have the ability to return a subsequent purchase of 7x or any future release. For example, if you have previously purchased and returned for refund a Professional Edition license you do not have the ability to return a subsequent purchase of Enterprise Edition.
Transferring your Manifold System license to a third party, as allowed on a one-time basis under the End User License Agreement (EULA), waives return privileges as does requesting an Activation key. Any violation of the End User License Agreement waives return privileges. For example, any evidence of attempts to defeat Manifold's serial number and activation system will waive return privileges. Failing to keep your serial number secret waives return privileges. For example, if your serial number appears on a hacker web site or in email correspondence or postings by other persons, you will lose your return privileges.
A free Trial Edition download is available for Manifold® Database Commander™ Please use this free Trial Edition to assess this product before ordering, since it is not returnable. Download only products are not returnable, nor are data sets.
For information on Activation keys, see the Activation page. The serial number provided to you when you purchase Manifold will allow it to run for up to 30 days from the date the serial number is issued without an Activation key. An Activation key is required for permanent installation. Requesting an Activation key terminates the return privilege.
General Shipping Information
Manifold System is not a downloadable product - it must be shipped on DVD. Please do not order "License Only" delivery if you do not already have possession of the DVD that will be required to install that version of Manifold System.
Not all products are available in hard copy, shipped form. 3D View Studio is available only as a downloaded product via the Manifold.net Online Store. Various data set products have different shipping rates. See the product listings in the Store for more information.

Payments / Chargebacks / Wire Errors
Cards: The preferred method of payment is to use an accepted credit card via the Online Store. Customers are advised to study this web site carefully or to contact manifold.net to resolve any questions or uncertainties before ordering products.
Chargebacks: Inappropriate chargebacks by credit card customers are costly to process and may subject the person making the chargeback to criminal and civil liability. If you wish to return a manifold.net product, see the Returns and Refunds section to accomplish a return, if qualified, without issuing a chargeback. Any unilateral chargebacks will be contested and will be subject to a $75 fee charged to your credit card. By ordering from manifold.net you agree to these terms and conditions and give manifold.net the authority to charge your credit card this $75 service fee to cover the cost of processing any chargeback you issue. If you subsequently chargeback that fee as well, your account will be forwarded to a collection agency for collection and a negative report will be issued to credit reporting agencies. Any chargeback will result in permanent cancellation of credit card purchasing privileges and cancellation of all licenses acquired by that customer. manifold.net prosecutes all misuse of credit cards to the fullest extent allowed by law.
Wire Errors: Wire transfer customers should take great care in obtaining full information before wiring funds to manifold.net. Any funds returned for wire transfers sent in error or otherwise cancelled will have a $150 wire transfer fee deducted. Please take the time to have all questions answered before sending a wire transfer to make sure you are ordering what you want.
General Licensing Information
All production manifold.net software is licensed, not sold, using our standard End User License Agreement. Please read the agreement to be sure you agree with its terms and provisions before ordering software. Upon installation, you will be presented with this agreement and be asked to accept its provisions as a condition of installation and use of the software. The agreement popped open upon installation supersedes any agreement on this website or in writing. In general, you need a Manifold license for every machine that runs Manifold with the exception that the licensee may install a single Manifold license both on a primary, non-portable machine as well as on a portable computer used principally by the licensee so long as Manifold is not run on both machines at the same time. This licensing feature is similar to that of Microsoft Office products and is intended to allow you to use Manifold on your office machine as well as on your notebook computer when away from the office.
Note that Manifold is licensed to you contingent upon your acceptance of all of the terms of the End User License Agreement, including those that set forth the use of anti-piracy measures such as the Manifold serial number copy protection scheme. Manifold is not licensed unconditionally: it is copy protected using a serial number and activation key mechanism that will limit usage in some circumstances. For example, you cannot install Manifold on many different machines and if you are in the habit of destroying your machine on a frequent basis you may run out of Activation keys. In such cases, you should expect that part of your expense in destroying machines or upgrading them on an unusually frequent basis will be the cost of acquiring replacement Manifold licenses should you run out of Activation keys.
Some Manifold features may not run forever. For example, certain command choices in the Help dialog launch web pages aimed at web sites that manifold.net thought might be helpful to users at the time your edition of Manifold was published. There is no guarantee that such web sites might not move or otherwise be discontinued. Likewise, some Manifold features make use of Microsoft or other software that might change in a way that such features are no longer supported. As far as software is concerned, you should not expect that functioning will continue if any change is made in your hardware or software configuration. Note also that future editions of Manifold may change to add or delete features. There is no guarantee that any future service pack or future edition of Manifold will include the precise set of features you favor, or that any future service pack or new edition will be offered to you for free or at a reduced price.
Licensing Manifold System or any other manifold.net product does not guarantee admission to any special programs that manifold.net in its sole and exclusive determination may elect to conduct. For example, licensing Manifold System does not imply any admission to beta test programs, participation in focus groups, participation in user meetings, academic licensing special offers, access to technical support or any other offer, product, service or program. What you license in Manifold System is only the contents delivered on the Manifold disc or other distribution medium. It is not a license to get consulting services, free upgrades, new versions of product, access to FTP sites, free data or anything else. Licensing Manifold System grants only those licensing rights set forth in the End User License Agreement.
Technical support is generally not provided with any manifold.net product but must be purchased as a support product. Some Manifold products may be provided with a limited number of free technical support incidents, typically two standard support incidents by email. Provision of any such free technical support incidents on a promotional basis is not in any way a commitment by manifold.net to provide any additional support services. Any technical support services provided, either for free or as a result of purchase of a technical support product, are provided without warranty of any kind. The sole and exclusive judgment of Manifold technical support staff will prevail in any dispute as to whether a support incident is required for support and if so, what kind of support incident (standard, development, etc.).
Like all software products, Manifold contains bugs some of which may be known and some of which will not be known at the time you license Manifold. Manifold does not warrant the product to be bug free or even to be free of grossly negligent errors. It is entirely up to the user to review the product, possibly taking advantage of the limited money-back guarantee if the user so chooses, to determine if the user wants to use Manifold. Manifold makes no promise whatsoever that any bugs will be fixed or that if any bugs are fixed that any service pack or new edition that fixes such bugs will be made available for free, for a reduced cost or even made available at all. At the sole and exclusive determination of Manifold, Manifold may choose to voluntarily provide or offer new versions of Manifold as updates, service packs or entirely new versions, or Manifold may choose to provide new products that are similar or not similar to Manifold but the voluntary provision or offering of any such updates, service packs, new versions, related or unrelated products will be entirely subject to whatever terms and conditions Manifold chooses to set forth. Your licensing of any existing version or product offering does not in any way give you any rights to any such updates, service packs, new versions, related or unrelated products.
Manifold.net reserves the right to decline to license or sell any product to any person or organization, or to cancel any transaction should manifold.net in its sole and exclusive judgment decide not to do business with a particular party. By way of example and not limitation, some reasons why manifold.net may choose not to do business with a given party or to cancel a particular transaction may include any actual or suspected illegal or immoral activity, any fraud or suspicion thereof in commercial transactions, previous history of chargebacks or other financial abuse, violations of licensing terms and conditions or any profanity, threats or other abusive behavior directed at Manifold employees, contractors, agents or representatives or threats or other abusive behavior within Manifold hosted user communities.
Note that the End User License Agreement for Manifold software explicitly specifies that the license terminates if the Agreement is violated. Any such termination may be automatically enforced by the software itself, and if such termination occurs you will not receive any refund for any licensing fees paid. For example, if you violate the Agreement by installing a single license of Manifold on multiple machines for use by multiple people the software will eventually terminate itself and will revoke the serial number for that license.
Serial Numbers
Manifold products are typically delivered by email in the form of serial numbers that authorize a license. When you order Manifold products, it is the customer's responsibility to provide a valid email address to which serial numbers can be sent. It is the customer's responsibility to assure that any anti-spam or other email features used by either the customer or the customer's agents (such as the ISP) do not prevent delivery and viewing of Manifold emails to the email address supplied by the customer. Problems with email reception must be resolved within 30 days of purchase to avoid service fees, so please follow up immediately if you have not received a serial number email for a new license when the order is processed (next business day after ordering).
When ordering Manifold products be careful to specify the email address to which you want your serial numbers sent. If you accidentally specify some wrong email address, such as the email address of a divorced spouse, a former employee or a business competitor, your serial number will be sent to that wrong email address and you may lose your licensing rights if the person receiving that email uses the serial number instead of you.
The value of your license is in the serial number, not in the DVD or any other physical media delivered. You can buy as many DVDs as you like but if you do not have a serial number for your Manifold license you cannot use that Manifold license. Your serial number is your license: lose the serial number and you lose your license.
Do not lose your serial numbers. If you lose your serial numbers, they cannot be recovered and you will lose your license. Serial numbers are very valuable information. If you lose your serial number, you will lose the value of the Manifold license that it authorizes. You will need your serial numbers to use your Manifold products or to get technical support.
If you lose your serial numbers, you will lose the ability to permanently install or to use the products they authorize, you will lose the ability to re-install your products or to move them to a new machine should you ever need to do so in the future and you will lose any ability to take advantage of future upgrade offers that require a Manifold serial number.
Do not expect that after using a serial number once you can safely lose it. Serial numbers are stored in Manifold products in encrypted form and cannot be recovered from the software installation: you will need your original serial numbers, so do not lose your serial numbers. Do not make the mistake of wasting money by paying for serial numbers and then losing them! Print out the serial numbers issued to you by manifold.net and keep them in a safe place. This is easy to do by printing the serial number email sent to you by manifold.net and by saving copies of that email as text files on backup media.
Under some limited circumstances it may be possible to recover a Manifold serial number for a fee. For a limited time, on an experimental basis manifold.net may offer Key Recovery Services for a fee. See the Key Recovery Services page for information on these services.
To successfully use your serial number to install and activate Manifold you will have to follow exactly the procedures set forth by manifold.net to accomplish such installation and activation. Such procedures are well within the capabilities of someone with ordinary intelligence who has the capacity to read and follow directions. Manifold.net is not obliged to assist anyone in following such directions, but if manifold.net chooses to do so voluntarily, such assistance will be provided only to the original licensee and not to any third party. Licensees are advised that any assistance so provided will be only for the current edition of Manifold System and any assistance for initial activation, if provided, will be provided only for a period of up to 90 days from the issuance of the serial number. For example, licensees should not acquire a Manifold license and then not do anything with it for three or four years and then expect assistance from manifold.net.
Annoyances
This page sure is annoying, right? It's amazing how much time has to be wasted on stating the obvious and other stuff because a small percentage of people are imbeciles, lazy to the point of gross negligence or crooks. Manifold relies on word-of-mouth advertising so we couldn't possibly have stayed in business with so many thousands of improvements over the years if our customers did not think it was a great product for normal people at a great price with a fair licensing deal all around. But unfortunately there is a tiny handful of utter idiots or irresponsible types who end up making life more expensive for everyone: you know, the folks who order delivery by mail and then complain the Post Office doesn't work as well as Federal Express, or the guy who orders Manifold, loses his serial number, goes off on a trip for three years without ever installing the package and then complains his dog ate his homework! We don't mind dealing with such people because that's part of running a business. We will do our best, however, to make sure such people don't make things more expensive for you. That's the whole point of this page, to prevent nitwits from costing you more money.
We hope all of our very many cool, responsible customers don't get put off by the terms and conditions on this page: they are there in large part to assure that the dorks out there don't get away with imposing higher costs that ultimately all other customers have to cover. Remember, every dollar that gets spent on higher costs is a dollar that has to come from you, the customer, so it's important to keep costs low. We hope you support that philosophy, so we can put as much as possible of every dollar you spend into creating a better product for you at a lower price than ever before.
